Court acquits expat of sexual harassment, rape attempt Citizen instructed to pay KD 5,000 to his ex-wife

KUWAIT CITY, April 26: The Criminal Court, chaired by Judge Hassan Al- Shammari, acquitted an expatriate of sexual harassment and attempted rape. The Public Prosecution had earlier charged the expatriate with breaking into the plaintiff’s home with the intention to rape her.

The complainant told the investigators the accused is her neighbour and he used to drop her at work, because she was living there alone. He allegedly called the woman one day seeking entry into the room, but she declined the request. He purportedly broke into the room and tried to rape her but she shouted for help, so he fled from the scene.

The defendant’s counsel, Attorney Saber Al-Enezi, countered the claim as the woman was not consistent and unreasonable. He raised doubt on the report of the prosecution officer due to the absence of proof that the door of the room was broken. He pointed out the officer accepted the claim of the plaintiff without conducting Forensic tests to determine if she was raped.

‘Pay KD 5,000 to ex-wife’: The Jaafari Personal Status Court, presided over by Judge Ali Al-Matooq, has instructed a citizen to pay KD5,000 to his ex-wife - the value of a car paid in instalments of KD70 monthly. Lawyer for the wife, Attorney Ali Al- Ali, said the couple was married legally and had three children.

After getting divorced, his client filed a case demanding for a car and a driver. He argued Article 1/346 should be applied on those who are in Imam Malick doctrine, as well as if any of the two parties is Kuwaiti and Sunni, law number 51/1984 must be applied.

Since both parties are following the Jaafari doctrine and their marriage and divorce have been legalized based on the same doctrine, it will be a failure for the court to use the previous law.
