Amiri Diwan urges all off tape case ‘RESPECT JUDICIAL INDEPENDENCE, SEPARATION OF POWERS’

KUWAIT CITY, April 9, (Agencies): The Amiri Diwan has called on everybody to steer clear of the controversial tape issue and let the Public Prosecution take the necessary action. “The Amiri Diwan urges everybody not to talk about this issue and let the Public Prosecution take the necessary action,” the Diwan said in a statement. As the matter is now before the Public Prosecution and the principle of judicial independence and separation of authorities ought to be respected, everybody in the country should not get involved in the case, it added.

The appeal comes two days after Sheikh Ahmad Fahad al- Sabah, a senior member of the family and former minister, was questioned by the public prosecutor for five hours about the tape, which he said he had handed over to Kuwait’s leaders. The Amiri Diwan acknowledged that there were reports of a tape and said the matter “is currently being handled by the public prosecution.” Meanwhile, a number of MPs appealed for calm, also urging people to allow the judiciary to deal with the issue. Since 2006, Kuwait has been rocked by a series of political disputes between the Sabah-controlled government and MPs. About a dozen governments have been formed and parliament dissolved on six occasions. After July parliamentary elections, in which pro-government candidates gained a majority, Kuwait has been relatively calm.

Former parliament speaker Jassem Al- Kharafi affirmed in a press statement he issued Wednesday evening that he will proceed with the petition he filed against those who wronged him in the so-called ‘tape of chaos’ case, which included allegations against him. In the press statement, he said, “When we resort to the judiciary, we believe we are in the right place to refute the allegations, disclose facts to the nation and demand for my rights in line with the Constitution and law”. He explained that the recent incidents related to the issue pushed him to proceed with the petition in order to refute the detrimental allegations, close the door of chaos and bring to books those who are aiming to harm the homeland.

Regarding the stance taken by HH Sheikh Nasser Al-Mohammad who did not submit a similar petition, Al-Kharafi said, “I respect and appreciate the viewpoint of HH Sheikh Nasser Al-Mohammad in refraining from taking similar procedures. This is a personal matter and his viewpoint in this regard must be respected”. At the same time, Al-Kharafi praised the statement issued by the Amiri Diwan to let the judiciary handle the issue. He affirmed, “The judiciary is a safe fortress for individuals and institutions in Kuwait”, adding that he hoped all concerned parts will cooperate with the Public Prosecution and the Advisor, and assist him by revealing any information they know about the case.
