Indemnity for 10 years end of service

I have been working for the last 10 years in a private company in Kuwait on an Article 18 (work permit) residency. I am planning to resign by the end of December 2014. Kindly inform me how I can calculate all my dues at the time of resignation, If I resign then, how much I will get and/or if company terminates me before I resign in that case how much I will be entitled to get? My salary is KD 300 per month. Please advise in full detail… I mean in both cases i.e. if company terminates me at any moment or if I resign.

Answer: In your case, as you have completed 10 years service, it makes no difference if you resign or are terminated because after completion of 10 years you are entitled to full indemnity and nothing can be deducted.

So the calculation in both cases will be as follows:

First five years 15 days pay for each year = 75 days but these will be divided by 26 working days = 75/26 = 2.88 months salary

The other years: one month’s salary for each year = 5 months salary

Total indemnity = 7.88 months salary = 7.88 x KD 300 = KD 2,364
