‘Kuwait determined to protect rights of expatriate workers’ ‘Protects both the employers & employees’

KUWAIT CITY, March 17: Assistant Undersecretary for Ministry of Social Affairs and Labor Jamal Al-Dousari affirmed that Kuwait is determined to protect the rights of expatriate workers, stressing that law 6/2010 concerning private sector regulates the labor market, while at the same time protects the rights of employers and employees, reports Al-Jaridah daily.

Al-Dousari clarified that this law bans employers from recruiting workers from inside and outside the country with deliberate intention of denying them employment in the same company, adding that employers in such situations will bear the cost of repatriating the affected employees back to their countries.

He indicated that the law also prohibits employers from engaging employees without due recourse to their primary employers, such that the supervising minister should issue relevant decision with necessary procedures, documents and fees payable by the concerned employer.

He stressed that the labor law entails guarantee of real job vacancies rather than the bogus ones to protect the employees and stabilize the labor market.

“Article 138 of the labor law stipulates that any employer who violates provisions of the Constitution in that regard is liable to three years maximum prison term with fine of minimum KD 1,000 and maximum KD 5,000 or either of the two penalties”, concluded the labor expert.
