Cheating by Property Developer from India

I booked some property in India through the developer’s agent in Kuwait. As per agreement I am entitled to a five per cent discount if I pay all the installments in time.
A cheque was handed to the developer’s local agent in Kuwait well in time to be delivered to the developer in India but due to the negligence of the agent it was delivered late to the developer.
Now I have been told that I am not entitled to the five per cent discount. What should I do? Can I sue the developer’s local agent in Kuwait to recover my losses?

Please remember that any company which operates in Kuwait comes under this country’s laws and in this case the company’s agents and through them the developer in India.

It seems that the company is trying to cheat you out of your five per cent discount. It was your responsibility to deliver the cheque in time to the agent within the stipulated time , which you did. And it was the responsibility of the agent to intimate to the developer that the cheque had been received and also deliver it to India in time.

This is something the agent and the developer should settle between themselves and not transfer the losses to you. So you can sue both the agent and the company in Kuwait and also in India. You can also file a complaint with the Ministry of Commerce and Industry so that the developer, through his agent, does not have a license to operate in Kuwait.
