3 voters petition court to cancel NA membership of MP Juwaihil ‘Appeals’ sets April 18 to hear petition filed by Qabazard and other accused

KUWAIT CITY, Feb 8: Three voters from the Third Constituency have submitted a petition to the Constitutional Court, demanding the cancellation of the National Assembly membership of MP Mohammad Al-Juwaihil due to his alleged incompetence and to consider his seat vacant.
The petitioners based their demand on law number 14/1975 on the establishment of the Constitutional Court, stating that “election petitions must be presented directly to the court in accordance with the laws issued in this regard.”
It is worth mentioning that the court might nullify the election results in the entire constituency if it finds irregularities in the electoral process in line with its monitoring role to ensure that election integrity is upheld.

Qabazard petition: The Court of Appeals, presided over by Judge Salahadin Yunus, adjourned the hearing of a petition, filed by Hassan Qabazard and the other accused to April 18, 2012, against the ruling of a lower court that had indicted them.
Earlier, the Court of First Instance presided over by Judge Abdullah Al-Sane, sentenced Qabazard to a jail term of 55 years, Abdul Fatah Al-Bader to 40 years, Naseem Hussein and Timothy Starford to 30 years each.
The accused parties stood trial for 13 charges out of which 11 were for undue profit and embezzlement and two were for forging official documents of an international company.
The court had ordered the accused parties to pay back the embezzled funds.

Bedouns trial postponed: The Criminal Court presided by Counselor Emad Al-Mindeel postponed the trial of three Bedouns, among them two doctors, accused of assaulting policemen until Feb 15.
Earlier, the Public Prosecution charged the three for pelting two police officers with stones while performing their duty, but the defendants justified the act, claiming those securitymen were brutalizing them.
Bedouns, in collaboration with unknown individuals, had defied the orders of securitymen to dissolve their gathering and instead retaliated by assaulting some officers and wrecking two police patrol cars deliberately.
