Annual leave - 30 days annual leave, to be calculated from Feb 20, 2010 onwards

With the new Labour Law in force, there is a lot of controversy on the enforcement of the clauses of this law, especially the annual leave. What is the actual position? If I joined my firm before the new Labour Law was enacted, what will be my leave?

Name withheld

Answer:
The law on annual leave is very clear and needs no bylaw. You are entitled to 30 days annual leave, to be calculated from Feb 20, 2010 onwards. You are subject to the old law only until Feb 19, 2010. On Feb 20, 2010, the new law came into force so your leave from that date will be calculated according to it. So according to the explanatory memorandum attached to the law you are entitled to 30 days annual leave every year regardless of how many days you have worked with the company. These should be 30 working days as official holidays are not counted among them.
