Annual leave payment

I worked with a private company for 360 days. Due to unavoidable circumstances I submitted my resignation. As per my contract I have to complete 365 days to be entitled to leave.
Please clarify if I can claim leave payment from the employer.

Name withheld

Answer:
Yes, you have a claim. Although you have signed a contract saying you are entitled to leave after 365 days, this contract has become invalid because according to the new labour law you can claim leave after nine months of service even in the first year.
Firms can give you more than mentioned in the Labour Law, not less and any contract which violates provisions of the Labour Law is invalid.
