Notice period - Cannot give 90 days notice only 45 days

In my contract letter it is mentioned that my notice period is 90 days. I have got a new job but I cannot give a 90-day notice. I can give only 45 days. And for the remaining 45 days, I am ready to pay an amount equal to the salary for that period. So my question is what should be my next step? Can I just leave the company after completing 45 days of notice period?

: You should first give the 45-day notice to your current employer. They could accept it but if they don’t you could tell them that you are willing to pay for the remaining part of the notice period. They still have to accept this condition for them to let you go. But if they don’t you can approach the Labor Ministry in your area.

shounSrivi | 12/31/2011 7:03:39 PM as per labour law, 90 days is a must. Even, if you file case, the case will be in favour of company. you cannot get release from shoun. The company will argue that, company has to arrange another person in lieu of your place, so they need 3 months time. till case is over. better convince company to accept your offer, 45 days. or work 90 days notice period. dont waste your time in shoun case.
