Indemnity payment done after transfer to other company

I have been working in a certain company for over ten years and now I’m tendering my resignation as per Kuwait law with three months notice. My last day of work is now fast approaching. My question, when can I take my settlement for my ten years. Is it before I leave the company or after I transfer to the new company? Please give me the information on this matter.

The indemnity is normally paid as soon as the transfer is done. But regardless of how things work out, the indemnity must be paid before an individual leaves the company so that when you join another firm you don’t have to collect dues from the previous one.

Company is obliged to pay your indemnity, irrespective of dues pending by business clients. once you left the company, you are no way connected to customer dues and company should pay your dues like indemnity, in time, once you left the company. If you are ready to bear the lawyer fees expenses, you can file case, you are the winner. but, company will pay your dues, before case is over. so, your money is waste. company will extend maximum possible to to court cases. better talk to management, settle amicably, to avoid waste of money.
Hold of IndemnityArhaan | 12/14/2011 11:52:35 AM I was working as a sales executive and now my ex company hold my indemnity because few of my clients (with them now my ex-company is doing business) some out standing amount is pending and they ask me when these customer clear the outstanding only that time they can pay me, so please let me know can i take legal action on them?
companySrivi | 12/14/2011 9:53:43 AM actual procedure, most of the companies, once you submit, your local transfer paper, you should sign all the indemnity calculation and settlement papers, then sponsor will sign local transfer paper. you go to shoun, make idnamel, change residency to new company. then bring new akama page in your passport, to old company, submit that you transferred your akama to new company. Then old company will pay your indemnity as per your signature, you signed already. If you satisfied the amount, which you signed already, then take local transfer, or file case before taking local transfer, before signing the settlement form. this is actual procedure. no other way, company can take risk. some companies will ask a settlement paper from ministry of justice, that you received, full settlement.
