Ex-MP gets jail with hard labour for abusing immigration chief Court sustains woman’s right to marital expenses

KUWAIT CITY, Oct 12: Former lawmaker Badi Al-Dousari has been sentenced to three months imprisonment with hard labour by a Misdemeanor Court supervised by Justice Mohammad Yousef Ja’afar. Al-Dousari is also compelled to pay KD 5,001 in temporary compensation to the plaintiff Major General Kamil Al-Awadhi while the civil aspect of the case has been referred to the concerned court, clearing Al-Awadhi of any wrongdoing.
It will be recalled that the Director of Immigration Major General Al-Awadhi had sued the defendant for verbal assault and humiliation while performing official duty. Al-Awadhi also accused the defendant of attacking another employee while on duty.
Likewise, the Public Prosecution accused Brigadier Al-Awadhi of abusing the defendant in public, but there was no evidence to this allegation.

Verdict annulled: The Personal Status Section of the Court of Appeals presided by Counselor Saleh Rashid Al-Rakdan canceled the verdict of a lower court that established a woman was disobedient to her husband and deprived her the right to marital expenses from the day she left the matrimonial home.
The court affirmed the woman’s right to marital expenses should be paid until the Court of Cassation decides on the divorce case filed by the couple. The appellant complained that his wife failed to honor the previous ruling and wanted the court to compel the woman to return to the matrimonial home.
The respondent lawyer Faisal Saqer Al-Rashidi faulted the ruling of the lower court and explained his client had filed another case for divorce, indicating the Court of Cassation is yet to make the final decision. The lawyer argued his client has the right to collect marital expenses from her husband until the court decides on the case, maintaining the woman hasn’t ignored the ruling of the lower court. However, he stressed the ruling can not stand while the divorce case is still pending in another court.
