Transfer of Visa before completion of 3 years - Hired from abroad

I work as a manager in a company drawing over KD 1,000/- per month. I came on a one-year contract with a private company. The period is almost over. With the consent of the present employer, I found another job. I would like to know the procedure regarding transfer of visa. After the cancellation of my present visa can the new company apply for my residence visa while I am still in Kuwait?

Answer: You cannot get a local transfer because you have not completed three years of service unless you are a graduate. But you can obtain a new visa from your new company. Your would-be sponsor can in fact apply for the new visa while you are still in Kuwait. The precondition is that your name should be taken off the computers of the ministries of Social Affairs and Interior. This can only be done after the cancellation of your residence. Then you can leave the company and return on the new visa.

But if company wants to add extra clause, you should carefully read and sign. it is normal practice in multi national companies, that you should not contact any customers for personal gain or job in same competitor companies for next 3 years of resigning current company. it is upto you, it is allowed, and competition business. But, labour law, will not control this type of conditions. it is between you and your company 2) after 3 years of work, if you resign you will get 15 days salary for every year, if you are terminated by company, then 1 month salary. so, it depends upon you resign or company terminate. 3) there is no labour law article for (1), but refer new labour law, for (2). it is acceptable, and available.

But, as per newspapers news, all project holders can transfer after 3 years of service. But, if your degree is attested, you can do transfer at any time. but, most of the shoun managers will not allow, in 3 years. so, it is purely depends upon manager approval. try ur luck. we cannot assure. but, possible at any time, if shoun manager approves. Try to get a project completion letter from old company, it is easy.

confuseSrivi | 10/9/2011 1:06:22 PM Dont confuse yourself. IF your current company is ready to release, then no other problem, other than shoun manager. If your degree is attested, then easy. If shoun manager approves, then you can do local transfer, with new company, without leaving kuwait. If current sponsor or shoun manager reject your transfer, then no other way, you should cancel your visa, go out and come of kuwait, in new visa. If you are inside kuwait, you cannot get any visa, as your name indicate, you are inside kuwait, till you exit airport, and old company to cancel your exit in shoun computer.
