Visa transfer to another company, but six months salary not paid

I need some legal help on the visa transfer issue. I came to Kuwait on the current company’s visa and I have worked over 5 years for the company. I have more than 6 months salaries pending with the company. Now if I want to transfer to a new company, after getting a job offer, then what would be my position if the current employer is not ready to release me even in this scenario?

The company has to release you after you have completed 3 years with them. They should also pay your six months salaries. If the company refuses to give you a release or pay your salaries just go to the Labor Office in your area and file a complaint.

no waiverSrivi | 9/11/2011 5:52:18 PM 3 months notice period is a must, for all types of leaving job, whether salary paid or not paid. salary is different from notice period and resignation. There is no waiver for 3 months notice period. first try for job, request employer to sign release form, request him to release immediately for 6 months, over due unable to pay salary. If sponsor refuse, file case in shoun, immediately. But, be careful, keep akama valid for 5 months, to clear shoun case, will take more time. Once shoun release, change akama to new company, then file case in shoun and court, for salary due, thru lawyer. you will get all your pending dues, salary and settlement. no need to worry. Proceed as per labour law, you are the winner.

Once new akama changed to new company, file case in shoun, for settlement and then in court thru lawyer. But, keep valid akama in passport. In case, employer refuse release, then file case immediately in shoun. release is different, salary due is different. salary you can see later. first change to new company, for salary.
