Leave during 3 months notice period

 I have been working with my company for three and a half years and now intend to change the sponsor. I have a transferable visa. I’m also planning to go for Hajj. I want to ask whether I can go for hajj in the three-month notice period or the company in which I am working has the right not to allow me that leave. It will be my first Hajj and according to the law I can have 21 days paid hajj leave.

You are entitled to this 21-day paid leave and the company has no right to stop you. The 3-month period is just like a normal working tenure except for the fact that you are leaving the company at the end of it.
But having said that, the company can reject your application if it feels that it will require 3 months to train your replacement or hand over your job to the person replacing you.
In principle, however, the law is with you as it is your right and you can approach the Labor Dept in your area to get your rights.

riskSrivi | 9/10/2011 3:44:34 PM Dont take risk, at last moment of leaving company. Request company to releave, because of hajj pilgrimage as a reason, leave amicably in last moment. Request company to arrange another replacement early, and accept your release in time. If you take risk, fight against company, you will loss your peace ful life, hajj pilgrimage and future shoun and court cases. There is no mention about leave during notice period, in labour law. The shoun officer and court, final deciding will be binding you, in case of dispute, to allow hajj leave including or excluding 3 month notice period is final. Dont take risk. settle amicably and arrange hajj pilgrimage.
