Indemnity for 5 years of work

I work for a Kuwaiti company and I’ve been thinking of resigning. I believe, according to Kuwait law, once you’ve worked over  5 years your indemnity increases. My friend recently resigned and he had over 5 years with the company but when he was paid the company said he had only worked a little over 4-years because they calculated working days minus the vacation days, holidays etc… Is the company correct?

No, the company is not correct. The weekly off days and the yearly paid vacation is counted in the service. The only thing that the company can deduct  are the days spent as unpaid leave.
Anyone who resigns with a service of over 5 years but less than 10 years is entitled to two-thirds of the total indemnity.
