Notice period

I am on Visa 22 (dependent) and working for a company. My visa was not transferred to the company because I had to complete one year on Visa 22. But now I want to leave this company. Do I still need to give them a 3-month notice or can I just inform them and leave in 1 month without paying for the other 2 months. I have to leave because of my daughter’s health. Can my company file any case against me or my husband. My husband works for the same company.

Yes, you have to give a 3-month notice unless the company says otherwise and relaxes the rule for you. If you leave after one month, the company could ask you to pay for the remaining two months. It can file a case against you if you don’t pay for the two months.
It, however, cannot ‘legally’ take any action against your husband.

So, Your company have no rights to ask for 3 months notice, even if company file case in shoun, shoun will ask fine for employing visa.22 holder. you are not in company muster roll, to abide by labour law. you are free to leave at any time. no need 3 months notice. company will afraid to file case, for illegal employee. but, it will hurt your husband, in other ways for deductions. take care.
