Notice period

I joined my current company on 10th August 2001. I have a good offer from another company. I resigned on 1st of July with a 3-month notice (01-July to 30-Sept). Am I entitled to full indemnity (10 years)? No contract between me and company. In this case is the 3-month notice period mandatory?

Name withheld

Answer: Yes, according to the new law you must get full indemnity after completion of 10 years of service. Secondly the 3-month notice is mandatory and can’t be avoided unless there is an agreement on this issue with the company management.

file caseSrivi | 7/5/2011 9:30:45 AM Go to riggae Rent court, file case and pay rent in court. Court will pay rent to your haris. Even building sold, you have rights to continue in same flat. Only in case of building demolition, you have to vacate after 3 or 6 months notice period. 1 month not acceptable. no rights. you have valid contract, you have all rights. request haris to issue new contract to continue in same flat, with new owner. To vacate building, you have to arrange an affidavit from ministry of justice, that 3 or 6 months you will vacate flat with rent and 3 or 6 months you stay without paying any rent.

company can releaseSrivi | 7/3/2011 10:10:00 AM if company wants, they can permit you to leave the job immediately. otherwise, 3 months notice is mandatory, to arrange another person in your post for replacement, to smooth running of your work to be continued in the company. yes, you will get full indemnity as per law, first 5 years as 15 days salary and after that 1 month salary for every year worked. contact is no way useful for indemnity and notice period, in front of new labour law. New labour law is final, 3 months notice must, or company can release at any time on mutual understanding.
