New Labor Law for all Leaves, regardless when person joined

I joined my current company in December 2009 and my probation period ended in March 2010 after the new Labor Law came into effect. I took my annual leave in October 2010, nine months after joining the company.
I have not been paid my leave salary because the company says since I joined in October 2009 my leave period is governed by the old Labor Law. Am I entitled to leave pay as per the new Labor Law?

Name withheld

Answer:
The company is wrong. All leaves, regardless of when a person joined the company, are governed by the new Labor Law. Your firm is just trying to cheat you out of your leave salary. All such companies should be reported to the Ministry of Social Affairs and Labor.

file caseSrivi | 5/21/2011 9:11:06 AM Date of joining is not important. Date of availing annual leave is accounted for calculation of labour law implemented period. As you are available annual leave after new labour law implemented, you are eligible to get as per new labour law. Date of joining is not accounted. only Date of availing annual leave, is a must.
