3 moths notice after Resignation

I would like to know the new terms and conditions for employees under the new Labour Law as regards the 3-month notice period. I have submitted my resignation requesting for a one-month notice period as I have to join my new place of employment at the earliest. But I have been told I have to work 3 months.

I did not come on their visa. It was a transferable visa. I have 15 days holidays due to me which they will not allow me to use or even accept payment of 2 months salary as penalty. Now that I have resigned I fear I will even lose my new job.

The company is right. If you want to leave the company earlier this has to be done through mutual arrangement. But if the company wants you to work, then you have no option but to work the 3 months.

avoid absconding caseSrivi | 3/9/2011 9:30:25 AM better avoid absconding case by company. first talk to new company, for 3 months time, to join, as per new labour law. they should agree. 3 months notice is compulsory, for company to arrange new staff in your place. company can pay 2 months, salary to terminate you, but you cannot force company to accept 2 months salary, to complete your pending works, and regular work of company. follow company. leave should not be linked to notice period.
