Appeals court acquits Moroccan woman in cheating, theft case Owner accuses salon worker
KUWAIT CITY, July 26: The Misdemeanor Court of Appeals Monday overturned the verdict of a lower court and acquitted a Moroccan woman of cheating and theft.
The Court of First Instance had considered her guilty and sentenced her to two months imprisonment for allegedly cheating her female sponsor and stealing from her KD 4,100.
According to case papers the defendant works in a salon owned by the plaintiff. The plaintiff claimed when the defendant went on vacation, she gave her KD 4,100 to buy makeup stuff for the salon from Morocco.
The plaintiff added when her employee returned from vacation she denied taking any money from the sponsor to bring the stuff. The sponsor tried in vain to get back the money and then filed a case against her.
The suspect neither appeared in court nor provided any defense. The Court of First Instance considered her guilty and sentenced her for two months in jail to be followed by deportation. The court also ordered her to pay KD 300 to suspend the sentence.
The accused through attorney Abdul Mohsen Al-Qattan filed an appeal at the Court of Appeals. The lawyer added the verdict of the lower court had made a mistake because there is no evidence to prove that the employee had committed a crime or taken the money from the plaintiff.
The session was presided over by Judge Mohammad Al-Khalaf.
