Notice period of 90 days in Contract

In my contract letter it is mentioned that my notice period is 90 days. I have got a new job but. I cannot give a 90-day notice. I can give only 45 days. And for the remaining 45 days, I am ready to pay an amount equal to the salary for that period. So my question is what should be my next step. Can I just leave the company after completing 45 days of notice period?

You should first give the 45-day notice to your current employer. They could accept it but if they don’t you could tell them that you are willing to pay for the remaining part of the notice period. They still have to accept this condition for them to let you go. But if they don’t you can approach the Labor Ministry in your area.

Everything should be in writingSrivi | 7/20/2010 9:03:08 AM Talk to top management, first resign. If they agree to release in 45 days, get in writing. If not agreed, request them to deduct 45 days salary for notice period. If agreed, give in writing and get acknowledgement as proof with company seal.
